1. Agreement to Terms

By accessing or using Waataly's water tank monitoring service, mobile application, website, and hardware products, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Waataly provides a water tank monitoring system consisting of:

  • Hardware sensors for measuring water levels
  • A mobile and web application for monitoring and control
  • Cloud services for data storage and processing
  • Optional pump control functionality
  • Alerts and notifications

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

We offer Free, Pro, and Business subscription tiers. Payment terms:

  • Subscription fees are billed in advance monthly or annually
  • All fees are quoted in Jamaican Dollars (JMD)
  • Fees are non-refundable except as stated in our Refund Policy
  • Subscriptions auto-renew unless cancelled

5. Hardware Products

Hardware products include a one-year limited warranty against manufacturing defects. The warranty does not cover:

  • Damage from accidents, misuse, or neglect
  • Damage from improper installation
  • Water damage to non-waterproof components
  • Normal wear and tear
  • Damage from power surges

6. Pump Control Disclaimer

Important: If you use pump control features, you acknowledge that electrical installation must be performed by a qualified electrician. Waataly is not liable for damage resulting from improper installation.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect or consequential damages
  • Our total liability shall not exceed the amount paid in the 12 months preceding the claim
  • We are not responsible for losses from sensor malfunction or connectivity issues

8. Termination

We may suspend or terminate your access for violation of these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • You may request export of your data within 30 days
  • We may delete your data after 90 days

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.
